Delara Darabi : la prisonnière des couleurs a été exécutée

Delara Darabi, une jeune peintre surnommée par les activistes réclamant sa libération, la prisonnière des couleurs (voir ses peintures) a été exécutée en Iran le 1er Mai 2009.
« Amnesty International est extrêmement choquée par l’exécution de Delara Darabi, qui a eu lieu à l’insu de l’avocat de la jeune femme alors qu’il doit, légalement, être informé quarante-huit heures à l’avance, a déclaré Hassiba Hadj Sahraoui, directrice adjointe du programme Moyen-Orient et Afrique du Nord d’Amnesty International.
L’Iran est un Etat partie au Pacte international sur les droits civils et politiques et à la Convention sur les droits de l’enfant. Ces deux textes interdisent formellement d’exécuter des condamnés qui avaient moins de 18 ans au moment de leur crime. De plus, devant la mobilisation internationale, le responsable du système judiciaire iranien avait accordé à Delara Darabi un sursis de deux mois le 19 avril 2009.
L’Union Européenne condamne “avec force” cette exécution
La présidence tchèque de l’Union européenne a «condamné avec force» l’exécution le 2 mai. «La présidence de l’Union européenne demande urgemment à l’Iran d’éviter toute exécution de mineur et d’éliminer la peine de mort pour les mineurs de son code pénal. De telles violations des droits de l’Homme sapent le terrain de compréhension et de confiance mutuelle entre l’Iran et l’Union européenne », déclarait le communiqué.
Miss Darabi was sentenced for crime she committed as juvenile at the age of 17. The Presidency strongly protests against her execution as an act running counter the international committments that Iran has voluntarily accepted. The Presidency of the European Union urgently calls on Iran to avoid any juvenile executions and to eliminate the death penalty for juveniles from its penal code. Such human rights violations erode the ground for understanding and mutual trust between Iran and the European Union.

Le gouvernement français a suivi peu après, appelant l’Iran a « à établir un moratoire sur les exécutions en vue d’une abolition à terme de la peine de mort ».
L’Iran exécute plus de mineurs que n’importe quel pays au monde. Selon Stop Child Executions, deux autres jeunes sont menacés d’une exécution imminente.
Un récent rapport de la Fédération Internationale des Droits de l’Homme1 dénonce la législation opaque de l’Iran sur les exécutions de mineurs et constate :
«La pratique habituelle en Iran consiste à garder un mineur reconnu coupable d’un crime passible de la peine capitale en prison jusqu’à ce qu’il atteigne l’âge de 18 ans, puis de l’exécuter.» 2

“Savez-vous ce que signifie “prisonnière des couleurs” ?
La prisonnière des couleurs, c’est moi. Moi qui, depuis l’âge de quatre ans, ai vu ma vie définie par les couleurs, je les ai perdues à l’âge de dix-sept ans. Un rouge crasseux a remplacé le bleu de cobalt, et je peins le ciel en gris. Et aujourd’hui, la seule image qui s’offre à ma vue jour après jour est celle d’un mur. Moi, Delara Darabi, vingt ans, convaincue de meurtre, condamnée à mort, je me défends depuis trois ans avec les couleurs, les formes et les expressions. Mes toiles sont les témoins assermentés d’un crime que je n’ai pas commis… Puissent les couleurs me rendre la vie…”

It means Del Ara.
I, whom from the age of 4 had my life divided by colors,
At the onset of my 17th birthday lost them.
I depicted grimy red as cobalt blue…
And in place of the skies I spread gray. I lost the colors.

Delara was a talented artist and used paintings to express her feelings. In 2006 there was an exhibition of her paintings in Tehran.

According to Delara Darabi the murder of her father’s female cousin was committed by her 19 year old boyfriend Amir Hossein Sotoudeh, whom she was in love with.
Delara initially confessed to the murder, but soon retracted her confession. She claimed that Amir Hossein asked her to admit responsibility for the murder to protect him from execution, believing that since she was under the age of 18, she could not be sentenced to death.
Delara Darabi’s death sentence was given by a lower court in the northern city of Rasht. Branch 107 (juvenile court) confirmed her execution in her second trial and yet again in Branch 33 of the Supreme Court.
Amir Hossein received a prison sentence of 10 years for his involvement in the crime.”
On May 1, 2009, Delara Darabi was executed in secret in Rasht Prison May 1 2009, without prior notification given to her attorney.
She is the second person to be executed this year after being convicted of a crime she was alleged to have committed while still under 18.

stories with an “American” angle – like the imprisonment of American journalist Roxana Saberi 3 in Iran – are more important than similar stories, like Delara Darabi’s, without the American angle. With Roxana Saberi, international media attention has been fierce — and because of that, so has international pressure on Iranian authorities. Had Delara Darabi had that kind of attention, she could have had a very different fate. But she didn’t get that attention – because she’s not American.
